1. Acceptance of Terms
Welcome to Bucketlyst. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Bucketlyst ("Company," "we," "us," or "our") governing your access to and use of the Bucketlyst website, mobile applications, and related services (collectively, the "Service").
By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
2. Definitions
- "Content" means any text, images, photos, videos, audio, or other materials uploaded, posted, or transmitted through the Service.
- "User Content" means Content created, uploaded, or shared by users, including bucket list items, journal entries, comments, profile information, and photos.
- "Hearts" means the virtual currency used within the Service to support and encourage other users' bucket list items.
- "Bucket List Item" means a goal, dream, or experience that a user creates and tracks on the Service.
- "Entry" means a journal entry or progress update associated with a bucket list item.
- "Sponsorship" means the act of sending Hearts to another user's bucket list item.
- "Catalog" means the curated collection of bucket list ideas provided by Bucketlyst.
3. Eligibility
To use the Service, you must:
- Be at least 13 years of age (or the minimum age required in your jurisdiction)
- If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you must have parental or guardian consent to use the Service
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
- Not have been previously banned or removed from the Service
By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time.
4. Account Registration and Security
4.1 Account Creation
To access certain features of the Service, you must create an account. We currently offer registration through Google Sign-In. By registering, you agree to provide accurate, current, and complete information.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
- Ensuring your account information remains accurate and up-to-date
4.3 Account Restrictions
You may not share your account credentials with others, create accounts for others without authorization, or create multiple accounts for abusive purposes. We reserve the right to disable accounts that violate these Terms.
5. Description of Service
Bucketlyst is a social platform that enables users to:
- Create, organize, and track personal bucket list goals
- Document progress through journal entries and photos
- Discover new experiences from our curated catalog of ideas
- Connect with other users through following, comments, and Hearts
- Share achievements and inspire others in the community
- Control privacy settings for their content and interactions
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
6. User Content and License
6.1 Ownership
You retain all ownership rights in the User Content you create and post on the Service. Bucketlyst does not claim ownership of your User Content.
6.2 License Grant
By posting User Content, you grant Bucketlyst a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating and providing the Service. This license continues even if you stop using the Service, but only for Content that has been shared with other users.
6.3 Content Representations
You represent and warrant that:
- You own or have the necessary rights to post and share your User Content
- Your User Content does not infringe any third party's intellectual property, privacy, or other rights
- Your User Content complies with these Terms and all applicable laws
6.4 Content Removal
We reserve the right, but have no obligation, to review, monitor, or remove User Content at our sole discretion. We may remove Content that violates these Terms or that we find objectionable without prior notice.
7. Hearts Virtual Currency
7.1 Nature of Hearts
Hearts are a virtual currency used exclusively within the Bucketlyst Service. Hearts are used to support and encourage other users' bucket list items, and they influence content visibility within the platform.
7.2 Obtaining Hearts
You may obtain Hearts through:
- Receiving Hearts from other users on your bucket list items
- Daily claims and streak bonuses
- Achievement rewards (including completion milestones)
- Purchasing Hearts through the Service (if offered in the future)
7.3 Hearts Terms
- Hearts have no monetary value and cannot be exchanged for cash or real currency
- Hearts are non-transferable except through the intended sponsorship mechanism
- If Hearts purchases are offered, purchased Hearts are non-refundable except as required by law
- Hearts may not be sold, traded, or transferred outside the Service
- We reserve the right to modify the Hearts system, including values and availability
- Unused Hearts may expire or be forfeited upon account termination
7.4 Prohibited Hearts Activities
You may not engage in Hearts manipulation, including creating fake accounts to generate Hearts, using automated systems to send Hearts, or participating in Hearts exchange schemes.
8. Feed Ranking and Algorithm
8.1 Algorithmic Ranking
Bucketlyst uses algorithmic ranking to determine the order in which content appears in feeds and discovery features. We believe in transparency about how our algorithm works.
8.2 Ranking Factors
Content ranking is influenced by:
- Total Hearts: Items with more Hearts rank higher (logarithmic scale)
- Heart Velocity: The rate of Hearts received in recent hours significantly impacts ranking - fast-rising content gets boosted
- Recency: Newer content receives a boost that decays over time
- Completion Status: Completed items may receive a small ranking bonus
- Follow Relationships: The Following feed shows only content from users you follow
8.3 Algorithm Changes
We may modify our ranking algorithm at any time to improve the user experience, prevent abuse, or for other reasons. Significant changes will be communicated through the Service or our help documentation.
9. Privacy Controls and Visibility
We provide granular privacy controls for your content:
- Public: Visible to all users and may appear in feeds
- Followers Only: Visible only to users who follow you
- Private: Visible only to you
You can also control who can comment on your items and send you Hearts. If messaging or tagging features are introduced, you will be able to manage those settings in your account privacy settings.
While we implement these privacy controls in good faith, you acknowledge that no security measure is perfect, and we cannot guarantee that private content will never be accessed by unauthorized parties.
10. Community Guidelines and Prohibited Conduct
10.1 Community Standards
Bucketlyst is a positive community focused on personal growth and inspiration. We expect all users to treat each other with respect and contribute constructively.
10.2 Prohibited Content
You may not post Content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
- Contains hate speech or promotes violence against individuals or groups
- Is sexually explicit or pornographic
- Promotes illegal activities, drugs, or weapons
- Contains personal or private information about others without consent
- Infringes intellectual property rights of others
- Is spam, misleading, or fraudulent
- Contains malware, viruses, or malicious code
- Promotes self-harm or dangerous activities
10.3 Prohibited Activities
You may not:
- Harass, bully, stalk, or intimidate other users
- Impersonate another person or entity
- Use the Service for unauthorized commercial purposes
- Attempt to gain unauthorized access to accounts or systems
- Use automated systems, bots, or scrapers without permission
- Interfere with or disrupt the Service or its servers
- Circumvent privacy controls or security measures
- Collect user information without consent
- Manipulate the Hearts system or ranking algorithm
- Create multiple accounts to evade bans or restrictions
10.4 Reporting and Enforcement
Users can report violations through the report feature on content and profiles. We investigate reports and may take action including content removal, warnings, temporary suspension, or permanent account termination.
11. Intellectual Property
11.1 Bucketlyst IP
The Service, including its design, features, content (excluding User Content), trademarks, and logos, is owned by Bucketlyst and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
11.2 Catalog Content
The curated bucket list catalog is proprietary content created or licensed by Bucketlyst. You may use catalog items for personal, non-commercial purposes within the Service but may not republish or commercialize the catalog.
11.3 Copyright Infringement
If you believe your copyrighted work has been infringed, please contact us at legal@bucketlyst.ca with the required information under the Digital Millennium Copyright Act (DMCA).
12. Third-Party Services
The Service may integrate with or contain links to third-party websites, services, or content. These include:
- Google Sign-In for authentication
- Supabase for data storage and backend services
- Payment processors (if Hearts purchases are offered)
- Cloud storage for media files
We are not responsible for third-party services, their content, privacy practices, or terms. Your use of third-party services is governed by their respective terms and policies.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy, reliability, or completeness of content
- Uninterrupted, secure, or error-free operation
- Results from use of the Service
We do not guarantee that bucket list items from the catalog are achievable, safe, or appropriate for all users. Users are responsible for assessing risks and making informed decisions about their activities.
14. Assumption of Risk
Important Safety Notice
Many bucket list activities involve inherent risks including physical danger, financial costs, legal requirements, and health considerations. You are solely responsible for evaluating and assuming these risks.
14.1 Your Responsibility
You acknowledge and agree that:
- Bucket list activities may involve significant physical, financial, legal, or personal risks
- You are solely responsible for researching, planning, and safely executing any activities you choose to pursue
- You must assess your own physical condition, skills, experience, and limitations before attempting any activity
- You are responsible for obtaining appropriate training, permits, insurance, equipment, and medical clearance as needed
- You must comply with all applicable laws, regulations, and safety guidelines
- You should consult professionals (doctors, guides, instructors, lawyers) when appropriate
14.2 No Endorsement of Activities
The inclusion of any activity in our catalog or on the Service does not constitute:
- A recommendation that the activity is safe or appropriate for you
- An endorsement of any specific location, provider, or method
- A guarantee that the activity is legal in your jurisdiction
- Verification that the activity information is accurate or current
- Assurance that the activity is achievable or advisable for any particular person
14.3 Release of Liability
BY USING THE SERVICE, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH ANY ACTIVITIES YOU CHOOSE TO PURSUE, WHETHER DISCOVERED THROUGH THE SERVICE OR OTHERWISE.
You release and discharge Bucketlyst, its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, or expenses arising from:
- Personal injury, illness, disability, or death
- Property damage or loss
- Financial losses or expenses
- Legal consequences or penalties
- Emotional distress or psychological harm
- Any other harm arising from your pursuit of bucket list activities
14.4 Examples of Risks
Without limitation, activities on the Service may involve risks such as:
- Adventure activities: Skydiving, bungee jumping, scuba diving, mountain climbing, and similar activities carry inherent risks of injury or death
- Travel: International travel involves risks including health hazards, political instability, crime, and natural disasters
- Physical challenges: Marathons, triathlons, and extreme sports require physical fitness and may cause injury
- Wildlife encounters: Interactions with wild animals can be dangerous and may be regulated by law
- Food and dining: Trying new foods may trigger allergies or food-borne illness
- Financial commitments: Some activities require significant financial investment with no guarantee of satisfaction
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUCKETLYST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
This includes, without limitation, damages for:
- Loss of profits, data, or goodwill
- Service interruption or system failure
- Unauthorized access to your account or data
- Content posted by third parties
- Any conduct or content of third parties on the Service
- Personal injury or property damage from activities inspired by the Service
Our total liability for any claims shall not exceed the greater of (a) the amount you paid us in the twelve months prior to the claim, or (b) one hundred dollars ($100 USD).
16. Indemnification
You agree to indemnify, defend, and hold harmless Bucketlyst and its officers, directors, employees, contractors, agents, licensors, and suppliers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) your activities related to bucket list items.
17. Termination
17.1 Termination by You
You may terminate your account at any time through the account settings page. Upon termination, your account will be deactivated and your data will be handled according to our Privacy Policy.
17.2 Termination by Us
We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violations of these Terms, fraudulent or illegal activity, or extended periods of inactivity.
17.3 Effect of Termination
Upon termination: (a) your right to use the Service ceases immediately; (b) we may delete your account data; (c) any unused Hearts will be forfeited; (d) provisions that by their nature should survive will continue to apply.
18. Modifications to Terms
We may modify these Terms at any time. When we make material changes, we will notify you through the Service, by email, or by posting a notice on our website. The "Last updated" date will reflect the most recent revision.
Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
19. Governing Law and Disputes
19.1 Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
19.2 Dispute Resolution
Before filing a legal claim, you agree to try to resolve the dispute informally by contacting us at legal@bucketlyst.ca. We will try to resolve the dispute within 30 days.
19.3 Jurisdiction
Any legal action or proceeding shall be brought exclusively in the courts located in Toronto, Ontario, Canada, and you consent to the jurisdiction of such courts.
20. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Bucketlyst regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations freely.
- Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.
- No Agency: Nothing in these Terms creates a partnership, joint venture, or agency relationship.
- Headings: Section headings are for convenience only and have no legal effect.
